Same-Day 1031 Closings: What Agents and Lenders Need on Both Files

People call it a simultaneous 1031 when the relinquished property and the replacement property are supposed to record on the same day. That is a scheduling fact. It is not a tax opinion, and it is not a reason for an agent to design the investor’s exchange.

What the Two Files Have to Do for Same-Day 1031 Closings

Executing same-day 1031 closings requires tight coordination and precise timing across both files:

  • Replacement property already under contract, not “we’ll find it at noon.”
  • QI papers (if the investor is using a QI) in both escrows before anyone records.
  • Sale proceeds wired where the instructions say QI or as counsel directed not to the investor.
  • Lender, title, payoffs, and signing actually ready on both sides the same day.
  • One officer who will pick up the phone when one county records and the other is still in line.

Two Setups You Will Hear

When planning same-day 1031 closings, you will typically encounter two different transaction setups:

1. Direct Swap

Two owners deed properties to each other. Rare. Counsel and the QI question still belong to the investor.

2. Sale and Purchase the Same Day

A third-party buyer takes the old property; the investor takes the new one. Funds are often parked with a Qualified Intermediary for minutes or hours so the investor never touches them.

Neither description decides tax treatment.

Same Day vs. Extra Days

A delayed 1031 exchange is the version with identification and replacement windows people quote as 45 and 180 days. A same-day plan has no spare day if the buyer’s loan misses funding or a deed is rejected.

Some files that miss the same day are then treated as delayed exchanges. Only the QI and the tax advisor say whether that still works.

Why These Files Are Uncommon

Same-day 1031 closings involve two recordings, two fundings, and often two lenders. One HOA packet or one short payoff can break the pairing.

Many investors use a delayed structure for that reason. That is their choice with their advisor not a sales pitch from escrow.

Instructions for the Opening Package

  1. Mark both orders “1031 / same-day target.”
  2. Put the QI on the wire instructions before the first signing.
  3. Call or text if either side wants to push recording “just to tomorrow.”

They already have both contracts and want both recordings on one date. This is driven by logistics, not a tax ranking.

Can same-day 1031 closings still go sideways with a QI on the file?

Yes. A QI holds money, it does not force a recorder or a lender to move faster.
