These Terms and Conditions (“Terms”) govern your use of the services provided by Nesi Title and Escrow Company (“Nesi,” “we,” “us,” or “our”). By engaging our services, opening an escrow, or using our website, you agree to these Terms.
Nesi Title and Escrow Company provides title and escrow services in connection with real estate transactions in California. We act as an independent escrow holder and title insurance agent. We do not provide legal advice, tax advice, or act as a real estate broker. Our role is limited to the administrative handling of escrows and title matters in accordance with the instructions we receive and applicable law.
Nothing on our website, in our communications, or in our services constitutes legal advice. You should consult your own attorney for legal questions regarding your transaction.
You agree to:
– Provide accurate and complete information in a timely manner.
– Respond promptly to requests for documents or signatures.
– Notify us immediately of any changes to contact information or transaction details.
– Comply with all applicable laws and escrow instructions.
By providing your email address or mobile number, you consent to receive communications from us electronically, including via email and SMS/text message. This includes transaction updates, document requests, reminders, and support messages. Message frequency varies. Message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. For help, reply HELP or call 310.845.6103.
To the maximum extent permitted by law, Nesi Title & Escrow Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, including but not limited to delays, lost profits, or damages resulting from third-party actions, market conditions, or your failure to provide timely or accurate information.
Our total liability shall not exceed the fees paid by you to Nesi for the specific transaction giving rise to the claim.
You agree to indemnify, defend, and hold harmless Nesi Title & Escrow Company, its officers, employees, and agents from and against any claims, damages, losses, or expenses arising from your breach of these Terms or your actions in connection with the transaction.
These Terms shall be governed by the laws of the State of California. Any dispute arising under these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
When you consent to receive SMS communications, you agree to the terms outlined in our SMS disclosure. We use SMS solely for transaction-related communications. We do not send marketing messages via SMS without separate consent.
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force. These Terms, together with any escrow instructions and our Privacy Policy, constitute the entire agreement between you and Nesi Title & Escrow Company.
